Self -production of electricity: operators emit reserves on the electricity self -production bill: operators issue reserves on the bill
The Government Council examined and adopted this Thursday, November 11, bill n ° 82.21 relating to electric self -production, presented by Leila Benali, the new Minister of Energy Transition and Sustainable Development.
According to the statement of the Government Council, the amendment project aims "to supervise the self -production activity of electrical energy for self -consumption, whatever the source of production, the nature of the network, the capacity ofThe installation used, while ensuring the safety and security of the national electrical network and respecting the principles of transparency and non-discrimination between all stakeholders ”.
The purpose of this bill is the amendment of the self -production law, a strategic text for operators in the renewable energies sector, because it allows them to operate on the average voltage segment despite the constraints.
It is therefore quite naturally scrutinized, to the nearby, by operators who believe today that this text deserves "that we linger a little more on it to improve it".
Already in the phase of the public inquiry, during its publication on the SGG site, the players in the sector had issued several reservations to which Media24 devoted an article in January 2021, such as the presence of imprisonment or multiplication of the multiplication ofStakeholders in the process.
Contacted by Médias24, a source to the Amisole tells us that the draft text has been improved."The imprisonment sentences have been abandoned from the bill -and so much the better -, but at the cost of a very significant increase in penalties. We can finally consider this as a return to normal, because prison terms do not have their place in a draft text which aims to encourage investment in a given sector. However, it is interesting to note that out of 34 articles, 9 concern the sanctions.»»
In its old version, the bill relating to self -production provided for criminal and pecuniary sanctions:
- 3 months to 1 year in prison and a fine of 100.000 DH to one million DH for any operation, amplification of capacity or modification of the production site without authorization.
- 2 months to 2 years in prison and a fine of 5.000 to 200.000 DH for any refusal of control by the competent authorities or presentation of erroneous data.
- fines of 10.000 to 20.000 DH for any exploitation, amplification of capacity or modification of the production site in contradiction with the provisions of the authorization issued, with entry of the equipment and substances used.

If the part relating to the sanctions has been reviewed, the Amisole believes that the basic problem persists.
Operators believe that there are still a multitude of questions to settle.
Operators emit reservations on certain articles in the bill."Article 4 which talks about the threshold is a real concern for us.
"Article 12, which sets the limit of 10% resale of surplus production, is insufficient. It should be at least 20% if we want to encourage self -production, especially solar.»»
"In article 16, the possibility given to the local network manager to order the cessation of local production, through the counter, is not acceptable, and should be bordered.»»
"Once again we refer in article 21 to the capacity which must be communicated annually by network managers.Without capacity, nothing is possible according to this law. However, the average voltage decree of 2015 provided for the envelopes, and years later, there was only one management which had communicated these envelopes precisely.
Finally, "in article 31, we are talking about regularization of the situation for existing installations, while the law cannot be retroactive.
